Association Covenants

The subdivision is comprised of  Sections A-K-2, each section having its own covenants and restrictions based upon a core document. The Lakes of Nicholas Homeowner’s Association, Inc. is assigned the power to administer and enforce all covenants and restrictions, to collect and disburse annual and special assessments and other charges for the common interest of property owners in the Lakes of Nicholas as a whole.

How much are annual dues?  When are they due? Where do I send them?

Dues are currently $160 per year as of January, 2024 and are due January 1 of each year. Send your check payable to Lakes of Nicholas HOA (annotate your address in the memo section) to Lakes of Nicholas HOA P.O. Box 1853 Southaven, MS 38671.

What do our annual dues pay for?

Dues pay for a number of items.  The largest expense is the lawn care for the entire neighborhood.  Other expenses include insurance for the HOA, mailings, property taxes for the common areas, utility payments for the water used by the irrigation system, and lighting.

How do I contact the board?

How long is the walking path around the lake?

0.3 Miles

Are all of the lakes accessible to neighborhood residents?

No, the lake abutting Marcia Louise and Lindsey Lane is a community lake.  The remaining lakes are situated on the private property of the homeowners surrounding those lakes.  Persons wishing to use these lakes should request the permission of the individual homeowners.  The association does not insure these “private” lakes.

Can residents vote to disband the association?

Yes, the covenants permit the members of the association to vote for the dissolution of the association thirty (30) years after the covenants are entered into. The dissolution of the association cannot be voted on until approximately the year 2033.

Is Robert’s Rule of Order required for Board Meetings?

No, the Bylaws of the Association do not provide for Roberts Rules of Order as the default procedure for managing meetings. Many organizations opt to use Roberts Rules when no procedure is promulgated. To date, meetings have not been hampered by our choice not to use Roberts Rules. It is of note that Robert’s Rules provides for the relaxation of rules when they are more cumbersome than other processes.

Can the Board President vote at Association meetings?

Yes, the Board President as a member of the homeowner’s association is entitled to one vote just the same as any other homeowner in good standing.  The President may abstain from an initial vote and later vote to break a tie if necessary.

Is approval needed for improvements owner’s make to their property?

Yes, it is required that any owner who is considering improvements on his deeded property to include, but not be limited to patio covers, decks, outside buildings, fencing, building add-ons, etc. submit the Lakes of Nicholas Improvements Request form to the Architectural Control Committee via mail or email prior to initiating work on the planned improvements.

What if I don’t pay my annual dues?

Not paying your assessment can be related to not paying any other bills, such as a home mortgage, rent or credit card bill.  If an owner withholds payment, the Board of Directors can and will seek legal action and, if necessary, place a lien on the property to recover all unpaid assessments.  In addition, the owner will be responsible for all legal costs associated with recovering the assessments.  It is in the best interest of the owner to contact the Treasurer immediately if you are unable to pay your assessment.  The Board of Directors is willing to work with owners in order to collect the assessment without placing an additional burden on the owner.

I’m behind on my payments.  Can I set up a payment plan?

The Board of Directors wants to work with you, not against you.  Collecting the assessment is important to the success of the community.  If you would like to set up a payment plan and avoid further fines and potential legal action, you are strongly encouraged to contact the Treasurer and attempt to work out a plan.

As with any executive officer, the president is responsible for running meetings, establishing the agenda and executing contracts and other legal documents pertaining to the HOA. Daily administration of the HOA also falls within the president’s purview.
